Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ImaraForge platform, website, APIs, and related services (collectively, the "Service") provided by Melhousen Solutions ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and authorized to bind the organization on whose behalf you are registering. Each organization account is governed by its designated administrator.

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete registration information.
• You agree to notify us immediately of any unauthorized use of your account.
• Organization administrators are responsible for managing user access within their organization.

3. Permitted Use

You may use the Service solely for lawful business purposes, including:

• Managing and monitoring IT infrastructure security
• Enrolling and scanning organizational devices
• Reviewing compliance reports and remediation recommendations
• Accessing the AI security copilot for threat analysis

4. Prohibited Conduct

You agree not to:

• Use the Service to scan, monitor, or attack systems you do not own or have authorization to assess
• Reverse-engineer, decompile, or extract source code from the Service
• Circumvent authentication, access controls, or usage limits
• Share credentials across organizations or allow unauthorized third-party access
• Use the Service in violation of any applicable law or regulation

5. Subscription & Billing

• Paid subscriptions are billed in advance on a monthly or annual basis.
• Pricing tiers (Basic, Growth, Enterprise) determine available features and device limits.
• You may upgrade, downgrade, or cancel your subscription at any time through the billing dashboard.
• Refunds are handled per our refund policy. Contact support for details.

6. Data Ownership

You retain ownership of all data you submit to the Service (scan results, device information, organization data). We do not claim ownership of your content. Our use of your data is governed by our Privacy Policy.

7. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control.

8. Intellectual Property

The Service, including its software, design, documentation, and trademarks, is owned by Melhousen Solutions and protected by applicable intellectual property laws. These Terms do not grant you rights to use our trademarks or branding without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, ImaraForge and Melhousen Solutions shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of account termination.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-platform notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved through binding arbitration or in the courts of the State of New York.
